RETURN, REFUND & CANCELLATION POLICY

Please read the following terms and conditions (collectively referred to as the “Return Policy”) before concluding a sale or offer to buy using www.omniverce.com . By using the OMNIVERCE website/application or digital platform, you signify your agreement to be bound by these conditions. OMNIVERCE Limited (OMNIVERCE) owns and operates www.omniverce.com  website and Applications (“Website”, “Application”, “Platform”, “Marketplace”).

Expressions like “you” and “your” with grammatical variations and cognate expression refers to any Customer, prospective customer, user, visitor, members, Maker, Designer, Institution or a party who visits/uses the Services to make an offer to Buy, or invites an expression of Interest to Sell any product listed on OMNIVERCE (a “buyer”).

Expressions – “We”, “Our” and “Us” with its grammatical variations and cognate expressions shall mean and include Makers, and Members who uses the OMNIVERCE Services to Sell, offer to Sell, or invites an expression of interest to Buy any product listed on OMNIVERCE (a “seller”).

The “Return Policy” constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures. Violation of the terms or this agreement constitutes an unauthorized use of the OMNIVERCE’s site and Applications in so far as the Buying or selling has contravened the terms of this agreement and may give rise to an actionable cause/claim against the violator.

RETURNING AN ITEM PURCHASED FROM OMNIVERCE

Return request can be placed online or through the App, if you’ve received an item in a ‘Damaged’ or ‘Defective’ state. The item can also be returned if it does not match the description of the item in the listing. The return request can be placed in the following ways-

  1. By asking for a doorstep pickup;
  2. By contacting us and sending an email to [email protected] ;
  3. By Couriering the item back to us;

IMPORTANT CONDITIONS FOR RETURN

The product returned shall be inspected on its receipt. Please ensure that the following conditions are fulfilled before returning the product:

  • The product shall be in unused and original condition;
  • You shall inform about the return of the product to us within a period of 7 days;
  • You shall not accept any open box deliveries;
  • The return package shall include everything that arrived with the package when you made the purchase, including price tags, labels, original packing, freebies & accessories, invoices/warranty cards and other documentation.

COVENANTS OF SELLERS

  1. Returns including all replacements/pickups are done free of cost.
  2. In case, the item returned is damaged or defective or not as per the listing specifications, the refund of the entire amount including Shipping charges would be processed to your account within a period of 7 days.
  3. Replacement is subject to availability of stock with the Seller. If possible, we will try to deliver the replacement while we pick-up or your drop-off the damaged/defective item. Further, in case, the Replacement is not available, the amount for the same shall be refunded back to your account.
  4. In cases, the replacement cannot be arranged at the earliest, we ensure the pickup at the earliest and make sure that the replacement is sent by the maker of the Product as soon as possible.
  5. In cases, where a pickup cannot be arranged by us due to logistics constraints in certain areas, you can ship the product through any courier agency. You will be reimbursed the shipping charges against the original receipt.
  6. Returns are subject to the Seller’s return policy. Returns are covered by the 7-day Replacement Guarantee for all Makers on OMNIVERCE for ready-made products other than made-to-order or customized goods

SITUATIONS WHERE MAKER/SELLER WILL NOT SUPPORT RETURNS

  1. If return request is made outside the specified time frame i.e. after a period of 7 days;
  2. If anything goes missing from the package you’ve received including price tags, labels, original packing, freebies and accessories etc;
  3. If the product is damaged due to misuse;
  4. If the products are Custom made by the Maker on special demand by the buyer;
  5. If any product that has been used or its durables have been installed on your site;
  6. If it is found that certain products with tampered or missing parts or serial numbers;
  7. If it is found that you have accepted an open box delivery, no request for return would be processed.
  8. If it includes certain products that can’t be returned due to health and hygiene matters.

 

CANCELLATION POLICY

This cancellation policy is applicable to the use of the services we provide to you on www.ominiverce.com .

Therefore cancellation shall be in use with respect to;

 

  A. Vendor/User Cancellation of Account

You may cancel your account at any time by emailing [email protected]

If you have bought a subscription and you cancel the Service in the middle of the month, you will receive one final invoice via email. Once that invoice has been paid you will not be charged again.

What you’ll see when you voluntarily cancel your account?

When an account is cancelled, you’ll receive an email notification. As always, you’ll be able to log in and access your cancelled account. You’ll want to double check your customer ID to ensure you’re looking at the right account. You’ll see an in-account notification letting you know your account’s been cancelled, but you can reactive it at any time by clicking “Reactivate” in the notification. If you don’t see that option and would like to reactivate your account, contact us at [email protected] . Please note that reactivation of cancelled account is not applicable to when we exercise our right to disable your account.

Omniverce Right to Disable Accounts:

(i) Inactivity:

Your account has been inactive for more than 15 months – meaning your account hasn’t been in operation for more than 15 months, and was automatically cancelled. If you manage other active accounts on the website, they will not be affected by the cancellation of your inactive account.

(ii) Fraud:

Without limiting any other remedies, Omniverce may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.

Note: no refunds are offered, even if a plan is cancelled mid-month.

Omniverce can suspend, cancel or terminate the account of the end user of any store

Without limiting its other remedies, Omniverce may immediately issue a warning, temporarily suspend, indefinitely suspend or immediately terminate this Agreement and your access to the Store(s) if you fail to comply with any terms specified herein. Omniverce may take such actions without providing you prior notice and at its sole discretion.

(iii) Third-Party Complaint

Omniverce reserves the right, in its sole and exclusive discretion, to suspend or terminate Services to you upon receipt of any third party complaint that you have engaged in any activity that violates this Agreement, which may otherwise subject Omniverce to liability for any reason, or that may cause Omniverce to incur legal fees or other expenses.

Upon termination, those provisions of this Agreement that expressly or by their nature survive will continue in full force and effect.

 B. Cancellation of Orders

Omniverce provides you with the option of cancelling any order made on www.omniverce.com before delivery.

Therefore, you can cancel your order online before the product has been shipped. Your entire order  amount would be refunded to you.

In case the item you have ordered has been shipped but has not yet been delivered to you, you may still cancel the order online. Your refund will be processed once we receive the originally ordered item back from the courier.

Unfortunately, an order cannot be cancelled once the item has been delivered to you.

In order to cancel an item in your order:

  • Log into your omniverce.comaccount and go to the ‘My Orders’ page
  • Identify the item you want to cancel and click on the corresponding ‘View Details’ link
  • In the detailed order page, you will see ‘Cancel’ links against each of the items in that order
  • Click on the ‘Cancel’ link, indicate the reason for cancellation, choose a mode of refund and confirm cancellation
  • Once your cancellation request is created, we will ensure that the cancellation is processed as soon as possible
